The event featured an engaging presentation by&nbsp;<a href="https://www.stpetebar.com/staff/details.asp?id=19563" target="_blank" rel="noopener">Melissa Byers</a>, Executive Director of the St. Petersburg Bar Association, who shared science-based strategies for cultivating resilience and managing stress in our fast-paced professional lives.</p><p>Drawing from her extensive leadership experience, Ms. Byers delivered a refreshingly practical wellness talk &mdash; blending research and real-world applications to inspire lasting personal change. Attendees appreciated her honest, relatable approach, which emphasized achievable tools for building healthy habits both at work and at home.</p><p>Special thanks for the delicious, healthy lunch generously sponsored by one of our office favorites, <strong>Palms of Largo</strong>. Together, we continue to build a culture of care&mdash;where wellness is not just a moment, but a movement.</p><p><em>Stay tuned for more highlights from Mindful May, and explore our full list of wellness activities and year-round <a href="https://www.dhclaw.com/blog/wellness-resources-page.cfm">mental health resources</a> here.</em></p><h2>Chef Alan&rsquo;s Kale &amp; Quinoa Salad</h2><blockquote>This vibrant, nutriend-packed salad brings together whole grains, hearty greens, and a bright mango vinaigrette for a refreshing and satisfying dish.</blockquote><h3>Ingredients</h3><ul><li>1/2 cup brown rice</li><li>1/2 cup white rice</li><li>1/2 cup black barley</li><li>1/2 cup red quinoa</li><li>1 cup fresh kale, finely minced</li><li>2-3 cloves garlic, minced</li><li>Cracked black pepper to taste</li><li>Himalayan pink sea salt to taste</li><li>1/4 - 1/2 cup mange vinaigrette dressing (to taste)</li><li>1 tbsp robust virgine olive oil (for sautéing)</li></ul><h3>Instructions</h3><ol><li><strong>Cook the Grains: </strong>Cook brown rice, white rice, black barley, and red quinoa separately according to their package instructions. Each grain has its own cooking time and water ratio, so be sure not to combine them in this step.</li><li><strong>Prepare the Kale: </strong>In a large skillet, heat the olive oil over medium heat. Add the minced kale and sauté until softened and slightly wilted, about 3-5 minutes.</li><li><strong>Add the Garlic: </strong>Stir in the minced garlic and cook for 1-2 more minutes until fragrant. As part of our Going Green initiatives, the firm recently replaced our gas-powered company van with a new, all-electric Ford E-Transit for office runs, community events, and more. In addition to environmental benefits such as zero tailpipe emissions, this powerful vehicle requires far less maintenance. We also installed two new electric vehicle (EV) charging stations that may be used, when available, by law firm clients and title company customers while at appointments or closings. Simply check with the receptionists. A second charger is reserved for longtime electric vehicle champion attorney <a href="https://www.dhclaw.com/bio/rep-deloach.cfm" target="_blank" rel="noopener">Rep DeLoach</a>. For instance, we recently used bamboo plates and serving ware at our Open House and strive to use real plates, silverware, and glasses for in-house luncheons and smaller events.</li><li><strong>Guest Speakers: </strong>Organizing Green Team sponsored "Lunch &amp; Learns" featuring guest speakers to educate and inspire our community.</li><li><strong>Florida-Friendly and Native Plants Landscaping:</strong> Promoting the use of Florida-Friendly landscapes, including Florida native plants, that require less water, fertilizer, and pesticides while providing habitats for wildlife and reducing pollution. This five-year period, also known as a look-back period, is designed to prevent individuals from giving away assets in order to qualify for Medicaid.&nbsp;The transfer penalty is calculated by taking the total value of assets transferred during the five-year look-back period and dividing it by the average monthly cost of nursing home care in the state ($10,438/m in 2024). The resulting number is the number of months that the individual will be ineligible for Medicaid benefits.</p> <p>For example, if an individual transferred $100,000 worth of assets during the five-year look-back period and the average monthly cost of nursing home care in the state is $10,438, the individual would be ineligible for Medicaid benefits for approximately 9.58 months. This penalty period starts to run when the Medicaid applicant applies for Medicaid and is Medicaid eligible. Medicaid does not impose a transfer penalty under the following circumstances:</p> <ul>  <li>Transfers to a spouse</li>  <li>Transfers to a disabled child (disabled as determined by Social Security)</li>  <li>Transfers to a child under age 21</li>  <li>Transfers of your home to a child who lived with the Medicaid applicant for 2 years and essentially kept the applicant from moving to a nursing home</li>  <li>Transfers of home equity to the applicant's sibling who was living with the applicant and who co-owned the home</li>  <li>Transfers to a trust for the benefit of a disabled child</li> </ul> <p>It is important to note that the transfer penalty applies to all types of assets, including cash, investments and land.</p> <h2>What about Other Gifts?</h2> <p>What if, as an example, Mom, age 80, gave away $20,000 to granddaughter to help pay for a down payment on her home. At age 83, Mom has a stroke, has to be in an nursing home, and runs out of money and needs to apply for Medicaid?&nbsp; This would create a transfer penalty under the rules. But, in this example, it may be possible to argue that a Medicaid transfer penalty should not apply. Medicaid creates a penalty so that people do not give money away to protect it from the nursing home. If it can be argued that Mom did not give this money away to protect it from the nursing home, a transfer penalty may not be imposed.
